Spouse visa renewal - my wife is pregnant

Post by ChugaLuvMe » Sat Feb 11, 2023 2:10 am

Hi all,

My wife is pregnant and due with our first child May 15 2023. Her BRP (spouse visa) expires June 23 2023.

When we renew, what documents/paperwork is needed for our child? I believe our daughter will hold USA and UK citizenship by birth, but at the time won't have a passport, or may not even be born if we choose to apply for renewal earlier.

Anyone have any guidance or links to guidance I can look at? Thanks.

Ordinarily none, however you may upload birth certificate to serve as further proof of subsisting relationship.I believe our daughter will hold USA and UK citizenship by birth, but at the time won't have a passport, or may not even be born if we choose to apply for renewal earlier.

So no additional income needed, just a birth cert? And they can deduce that our daughter is British? I swear I did search on Google many keywords but nothing of relevance come up, so i came to the only place I know.

Use the income of either of you that meets the financial requirements.

If you are British or settled here in the UK, they would know that by Birth in the UK, your child is British. More so, your British passport or ILR proof would be required during your wife's spouse visa renewal. HO knows the rules and wouldn't bother about the kid. I swear I did search on Google many keywords but nothing of relevance come up, so i came to the only place I know.
No sin in failing, you just have to try and try again!

The application will ask for the child's name, date of birth, languages spoken (I know, totally silly) and passport number, leave it blank, if it doesn't let you proceed write N/A and in a cover letter explain the child was born on x date and passport has yet to be applied.

The application itself has to be supported by the birth certificate, so just ensure this is in place ahead of submissions, I had the certificate done within 28 days of birth, some councils have a delay just be mindful of this.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

Ok that's great I will keep this in mind. Not sure when our baby will be born (due date is mid-May) and her visa expires June 2023 so hopefully should have a birth cert. by time we apply.
