Guidance on wife's visa category and FLR(M) extension

Guidance on wife's visa category and FLR(M) extension

Dear Admins,

Requesting guidance on below 2 questions regarding my wife's visa.

1) So I got my ILR under 10 year route in May 2021. Based on that wife moved to FLR(M) from Tier 2 ICT dependent visa as she still had time before completing 10 years for ILR. I have now got my British passport so can my wife continue to stay on FLR(M) or does she have to change to any other category till she is eligible for ILR?

2) Assuming she can continue on FLR(M) - Her FLR(M) visa is valid till mid- Feb 2024 and she is eligible to apply for ILR under 10 year route in April end 2024. Can the FLR(M) extension be done only for few months or is it always for 2.5 years and consequently have to pay the full fees?

There is standard duration to apply for, it is not done piecemeal or in bits as applicants desires.
What can be done is to apply for the extension, refrain from attending biometrics early then vary it to ILR

Hi AmazonianX, thanks for your reply. On the 2nd point, can you share some details like on how we can vary it, what it means in terms of fees as I imagine we would have to pay the fees when applying for FLR(M) extension. Also, how long we can wait when varying etc.

Thanks AmazonianX. One of the statements in the link said that the date of application would be the date of the previous application. So, let's says I vary the application in April when ILR is eligible, it would actually take the date of Feb when the ILR eligibility hasn't kicked in yet. Would this not create a problem with the application?

Would this not create a problem with the application? No, the date of decision making will be used and hence advantageous to you. If not, what's one of the purpose of varying? Use the search function of the forum to get an idea of how often people do it and successfully too.
