After marriage when he applied for H1B extension from India, his visa was rejected on baseless assumptions. All he did was - As a part of his job responsibilities when working in US, he gave reference to an Indian for his visa requirement as adviced by his boss. He is very sincere at his work. He is a contracter in that company and it seems that as per the rules, a contracter is not supposed to give reference. When his visa was in problem, his boss or anybody at his workplace in US failed to give any kind of support. And he had to face the charge - "Alien Smuggling". And he couldnt go back to US from then on. He is fighting the case through the immigration lawyers in US since the last 2 1/2 years but in vain. Though he has no plans to go back to US, he wants to prove himself innocent, so he is still waiting for a miracle...
Now he wants to apply for HSMP. In that application, there is a question - Have you been refused a visa by any other country other than UK ? also give reasons - Should he write a detailed letter to the consulate officer about this whole story? Wouldn't that confuse him and make him suspective. The officer may not pay much attention to other details with that letter. Should we breifly write the case in the application itself? We dont know what to do. Kindly advise.

Sorry that really doesnt add up? Alien smuggling? but he was a contractor. What was his work providing subcontractors??? seems a bit strange to me.sandyjones18 wrote:A friend of mine is planning to apply for HSMP. Anyway, I find it hard to follow all this detail because it sounds like something is missing as it still doesnt make sense.sandyjones18 wrote:The term is very scary. But till today we could not understand what made the consulate officer do this. My friend was working for one of the top companies in US as a system analyst in the IT field. All he was told when his visa was rejected that he has referred some person. But he had to refer because he was asked by his boss (an american). When the consulate officer started to contact his boss and anybody from his team, they refused to give any support. Till this day, he is fighting through the immigration lawyers to prove his innocence. Though they do not have any evidence regarding this, they do not want to reverse their decision.
This is the power of fate. The real criminals go scott free and innocents are always the scapegoats.
