Advice please

Post by hamid84 » Mon Dec 01, 2008 3:56 pm

I got married last year with an international student when i was an asylum seeker and now we have a 7 months old baby.

Last month, i was granted ILR so my question is, what is the nationality of my son? Should i apply for his pakistani passport or british?

Also, my wife's student visa expires in Feb so how should i make her my dependant? What do we need to do to make sure she stays with me in UK and we have a happy life.

Thanks

Where did you get married, in the UK?

If so you can apply for an in country spouse visa but expect a refusal as they will state she has to go to her home country and apply from there.
If her home country is PAK then you might succeed with the in country application if you were granted asylum. If you were not granted asylum then you are going to struggle with anything other than her returning home to apply.

Frontier Mole - if it is for a spouse visa and she is legally resident here, why would she have to return to Pakistan to apply? I know of many cases where students have successfully applied for spouse visas in-country (as well as those on HSMP or any other long-term visa).

Hamid, if your child was born in the UK, then I believe s/he can be registered as a British citizen, and then subsequently, you can apply for a British passport.

Frontier mole.... I have been granted ILR so that means asylum is granted.

We did Islamic Nikah so not registered in UK as couple. Son was born in UK.

Sakura.. As you said, i can apply for my son's citizenship.. Please tell me what's the procedure for that?

Regarding my wife, would we need to apply for COA and then register our marriage to be recognised?

Please let me know the steps one by one so that i do not get lost.

Thanks in advanced
