Skilled Worker Dependent - New Passport - Outside of UK

Hello All,

My spouse has a skilled worker dependent visa and went to India for child birth an year ago. In order to get a passport for our new born, my spouse endorsed my name on her passport. I had the following questions before she can come back to the UK please -

1) She’s been outside of UK for more than a year, can she travel back to the UK?
2) Should we inform home office about the new passport that was issued to her? If yes, how can we do it?

PS : My Spouse has a BRP which is valid until dec 2024

2) Should we inform home office about the new passport that was issued to her? Not required If yes, how can we do it?

Note that if her absences from the UK broke the Continuous residence requirement for settlement as a dependent partner of a Skilled Worker

SW 43.1. The applicant must meet the continuous residence requirement as set out in Appendix Continuous Residence during the period in SW 42.1.

Where Qualifying period requirement for settlement as a dependent partner of a Skilled Worker

SW 42.1. The applicant must have spent a continuous period of 5 years in the UK with permission as a dependent partner of the person (P) in SW 39.1.

then her 5-year qualifying period for ILR as a Skilled worker dependant will be reset upon her return.

I understand her continuous period for qualifying will be reset but I hope she can still return with her existing BRP which is still valid until 2024?

Yes, if her absence is also less than 2 years, subject to 13(4).
