Sponsor License Expired & Renewed-Employee to new CoS transfer pending - Travel advice required

Post by ganesh1107kumar » Wed May 03, 2023 9:30 pm

Hi All,

Just need important advice on my Immigration status.

Myself (Skilled worker) and my family (Dependents) are on a Tier 2 Visa sponsored by my employer. Recently, my employer missed to renew their Sponsor licence and it got expired. However, they have renewed within the timeline and got CoS allocation reinstated as before. But a decision is still pending at home office whether I can be transferred to the new license or they need to reapply for bio-metrics for getting a new BRP which might take 6 - 12 months to answer. My visa right to work is valid and Immigration status is secured currently.

I checked with UKVI and they responded that its fine as it shows the I have valid right to work in the UK. But as per the website, it will show valid for 60 days even if Sponsor license is expired/cancelled/revoked. What will it show on my Right to work check if performed after 60 days?

I need to travel to my country for a personal important visit soon (after 60 days period) and I am confused whether this situation may affect during my re-entry into UK.

Has someone else faced this situation previously. Please advice. 🙏

The advice you got probably from third party entities employed to man contact centre.
Till you are transferred or get response from the appropriate section in HO written and clearly stating it will advise against travel.
