Visitor Visa Refused - Advise Cooling off period for Reapplication

Post by ganesh1107kumar » Sun Jun 11, 2023 11:48 am

Please find below the Visitor Visa refusal reason.

I am planning to address all the points mentioned and reapply again with proper evidence as this is a genuine application and ended up getting refused when applied through an agent without adequate knowledge.

I need advise whether I can reapply immediately or need to wait for a certain period before reapplication.

Please let me know. Thanks in advance.

The decision
I have refused your application for a visit visa because I am not satisfied that you meet the
requirements of paragraph(s) V4.2 – V4.6 of Appendix V: Visitor because
You state you wish to travel to the United Kingdom for 2 month 26 days for the purpose of
family.
• Whilst I recognise that family visits are important, I must consider the information
regarding your sponsor’s support of your visit separately in my assessment of your
application. To consider whether or not I am satisfied that your intentions are as stated
and that you meet the requirements of the Immigration Rules I must assess your own
personal and economic circumstances.
• In assessing your eligibility for entry to the UK, I considered your personal and financial
circumstances as evidenced by your application form and supporting documents.
• You state you are unemployed and that you have other income 698,000 INR
(£6,806.48) per annum, with no savings. You also state that you spend 30,000 INR
(£292.542 where £1 = 102.549 INR as per Oanda.com on 25/05/2023) per month and
that you will spend 100,000 INR (£975.14) on this trip out of your own expenses, whilst
your Daughter will provide (£3,000) Since you have no income, this degree of
expenditure on a short trip appears disproportionate to your current economic
circumstances and leads me to doubt your true intentions to visit the UK.
• I acknowledge you have provided a bank statement Central Bank, in your name with
a closing balance of 712,870.26 INR (£6,951.48) dated 09/05/2023, ending in account
number 9110. I acknowledge the account show's multiple cash deposits of unknown
origin. I am not satisfied from the documents provided you have shown a full picture of
your financial circumstances. You have stated that you are travelling alone, have
declared family in the UK. You state you are currently unemployed and it is unclear
from the information you have provided, how you are supported financially on a day to
day basis. I am not satisfied that the information you have given demonstrates that you
are independently established with strong ties to your home country to ensure you
intend a genuine visit or that you will leave the UK at the end of your visit. Your
application is therefore refused under paragraph V 4.2 (a) and (c) of the Immigration
Rules.
• You have indicated that your Daughter will pay (£3,000) towards the cost of your trip.
You have provided a bank statement in your daughter’s name from Barclays Bank,
account ending 4395. I note that the balance seen on this account stands at (£120.46)
dated 14/04/2023. I am therefore not satisfied that the impact the sponsorship would
have on your daughter’s financial circumstances that such a sponsorship is viable and
credible. I am not satisfied that the information submitted confirms the ability of your
sponsor to finance you as stated. Consequently I am not satisfied that you will be
maintained and accommodated in the UK without recourse to work or public funds. I
am therefore not satisfied that your sponsor can and will provide you with support for
the intended duration of your stay. Your application is therefore refused under
paragraph V4.3 (c) of the Immigration Rules
.

There is no cooling off period required for reapplication. But keep in mind that a former refusal may cause any subsequent application to be given more scrutiny.

There are questions about both his finances (untraceable cash deposits will always be looked at askance in such cases) and the sponsor's finances.

This is what you will have to address in some detail, especially if your father is unemployed. What compelling reason(s) will cause your father to move back to his country of habitual residence and not stay over with his family in the UK?
