Hello

Please i would appreciate your advice.

Im a british citizen and have two kids. The father of my last kid (my spouse) is back home and we are looking to apply for him to come here to come stay with me and the kids and also start working.

Things are a bit tight financially and stopping my Universal Credit before his application would really stress me financially as i would be unable to survive. (i work full time get about £39k a year and top up of about £600 a month from UC, so im not strictly on benefits). I definitely don't mind stopping the benefits when he is in here and has found work.

Because of this , we are looking at either the spouse visa or Parent visa (father of my last born). pls
  • would both routes require me to stop my Universal credit before i apply for him?
    • which one is better generally ?

If a person is eligible to apply both as a partner and as a parent, they are required to apply as a partner. They can only apply as a parent if they are not eligible to qualify as a partner.

So, in your case, your partner will need to apply as a spouse, not as a parent.

Thank you very much for your reply. ok That shouldn't be a problem. Just more uncertain about the Universal credit if anyone else has any thoughts?
