What is the status of my partner??

Post by lahorie » Sun May 29, 2005 6:10 pm

Hello

My wife arrived in the UK on a settlement visa in February this year. Due to various problems , she has now decided she does not want to live with me and has moved in with her cousins. I am very frustrated about this as it seems i have been used to get her into this country. Is there any action i could take to get her sent back and is there anyway she could stay in the UK as it stipulates clearly on hervisa she must live with her spouse.

Yours very frustrated

So she has a two-year spouse visa. In practice it is unlikely that IND will try to remove here from the UK. However when her current visa is nearly ending, what will she do? She would need your signature on the application form SET(M) and clearly you will not be prepared to sign that.

How soon after arriving in the UK did she leave you? What evidience is there that was always her intnetion, or was it something that just happened after she arrived?

Hi John

thanks for the reply..much appreciated.

She arrived in february this year and left on 21st of may so only here for about 3 months....it came totally out of the blue. Her parents who are overseas will not speak with me which is why i have my suspicions. She has not contacted me since although i have tried in order to ascertain what's going on.

I hope this helps John.

Same issue has featured on this forum - each event has 2 sides and what we have is yours. If relationship has come to an end notify the HO in writing to this effect and further state you are withdrawing your sponsorship. Such will carry more impact if a formal document via divorce/ marital lawyer pertaining to formal legal separation. HO will then deal as appropriate with your spouse including matters of leaving the UK. Don't expect such to be instantaneous. Focus on moving forward with your life and don't do anything foolhardy.

Good luck

Thanks Kaylami.

It's what i needed to know - to contact the home office. I will do this through my solicitor.

Cheers
