ILR Queries for my Spouse due to Health Condition

Post by kpkumar » Sat Jul 29, 2023 5:55 pm

Hi All,

Noob here, so apologies if this is a daft question.

My spouse & I have become eligible for the ILR(5 year visa Route) at the same time this month. I have a few questions due to my spouse's health condition.

My spouse had a brain stroke last year and her right body is paralyzed. She can't sign with her right hand and also has memory problems. So, she is taking more time to complete life in the UK test.

Is there any option to request a waiver for life in the uk test for her (32 years) based on her health (stroke) condition?

For the English language, we will be using an ECCTIS certificate.

Our current leave to remain visa is valid until Aug 2024. If I apply for ILR alone as the main applicant, does it impact my wife's current skilled worker dependent visa validity?

If not, can my spouse continue on the dependent visa and apply for ILR once she clears life in the UK test before her leave to remain visa expires in August 2024 ?

Also, my wife can't sign with her right hand. Can she sign with her left hand in the application even though it will not match with BRP card ? If yes , do we need to submit a cover letter or a letter from her GP for this?

Appreciate, for your quick response and your valuable time.

You may apply for a waiver if a GP confirms that she suffers from a long-term condition. There is a waiver form which must be completed by a General Medical Council registered medical practitioner who is able to comment on her condition: https://assets.publishing.service.gov.u ... _KOLL_.pdf

You may apply for ILR on your own as you are the main applicant. She can remain a dependant without any issues and apply only when she can fulfil the ILR requirements.

Thanks, a lot Zimba for quick response.

Could you please also comment on the signature issue query if any cover letter or support letter from gp required to do a signature with her left hand?

Thanks in advance

Applications are submitted online and only require a click to confirm applicant understands everything.
This is just my opinion as a member of this forum and does not constitute immigration advice.

Thanks alterhase58 for your response.

Online Application process is Stright forward with clicks. But, I think we need to upload/submit consent and declaration form along with application for using any joint named documents (Likes of Council Bill, or bank accounts etc )

Thanks,
Kp

I would hope case workers would concentrate on assessing whether you meet all requirements rather than comparing signatures. However, for peace of mind you could attach a note explaining the handwriting issue.

You can sign with any hand. Your signature is not expected to be done with a specific hand :?

ILR Query on previously lived in a country outside the UK

Post by kpkumar » Fri Aug 04, 2023 9:29 pm

Hi All,

I have Query to Previously lived in a country outside the UK, including your country of birth.
How to fill these details in the ILR application based on the below dates where I lived ?

Lived in India :- From Birth till 26th Jan 2018.
Came to UK on the ICT Longer-term staff migrant visa from 27th Jan 2108 till 26th April 2018.
Went back to India after my assignment was over and continued to Live in India from 27th April till 4th Aug 2018.
Do I need to enter India twice based on the dates lived in India? And also add UK as another country to fill 89 days stay?

Thanks in advance.
Kp.

Yes, the times before coming to UK and when back to India from UK.
No need to enter times in UK, the question clear on that.
