Dependent partner to ILR for my partner

Dependent partner to ILR for my partner

Hello,

I have been working in the UK for 5 years and obtained ILR 1.5 years ago. I am currently awaiting the decision on my UK naturalisation application. My partner has been my dependent for 4 years and is now eligible to apply for ILR as well.

I have some questions that I need clarification on:

1. Is it possible for my partner to apply for ILR while my naturalisation application is still pending? What are the potential risks or consequences of doing so?
2. Should my partner apply for ILR independently or should I apply on her behalf using the “apply for someone else” option?

I am confused about this because when my partner fills in the application form, there is a question that asks her “visa has applied or been granted”, but there is no option for “dependent partner visa”.

1. Your naturalisation application has nothing to do with her ILR application. You just had to be granted ILR under the same visa route as hers, at some point in the past.
2. Maybe because she was granted Tier 2 dependant, now called the Skilled worker dependant visa. She is the applicant and she applies on her own. I assume she never switched to the family route after you got your ILR as that resets her ILR clock

sorry my typo. She has been my dependent for 5 years now.

"I assume she never switched to the family route after you got your ILR as that resets her ILR clock" Are you sure that is true? I heard many people said forum that we should not switch visa type in that case otherwise it will reset ILR lock.

That's what zimba is saying - you should not switch visa time as it resets ILR clock.
Did your wife have Skilled Worker/Tier 2 dependent visa for these 5 years?

Correct, don't switch so as not to reset ILR clock. Extend as dependent.
