Wrongly input as a New Entrant!

Dear all,

Hope you are all well.

I am 29 years old and currently under Graduate Visa which will be expired on March 2023. My employer is going to sponsor me with a 3-year-long Skilled Worker Visa.

I have been under Graduate Visa around a year and half. I was informed by my employer that they put me as a new entrant on CoS. I am aware of the 4 year period requirement on the definition of New Entrant, which I believe I won’t be fully meeting the requirement as I will be in the UK for 4 and half years when the 3-year-long Skilled Work visa expires.

However, I’m getting paid more than both the going rate of the SOC and the minimum salary (£26,200).

My question is that if a Sponsor Note attached to my CoS clarifying the marking up me as a new entrant would be acceptable in this case in general? Or it can be seen that the auditor would simply use Option A (Full Salary) instead of Option E (New Entrant) for the process?

My employer had only one allocation chance of CoS which has been used to issue the CoS mentioned above. Therefore, issuing a new CoS would be impossible without requesting extra allocation capacity.
