Redundancy situation and new GEP

Post by kufri333 » Thu Aug 24, 2023 10:36 am

After completing my Msc, I worked with an MNC on Stamp 1 for 1.5 years. Due to global headwinds, my job became redundant recently. I have also notified the authorities regarding my Redundancy within 4 weeks of my redundancy date as per the rules.

If I were to get an offer for a job under Stamp 1 again with another company, I’m curious about how easy it is to get a new GEP.

The redundancy law states this on the Govt website: "If you find another job and provided you have submitted the prescribed Redundancy Notification Form within 4 weeks of your redundancy date, you will be exempted from certain rules that would otherwise apply, that is, Labour Market Needs Test, and eligibility criteria in relation to the job. If you have been made redundant from an occupation that is subsequently ineligible for the type of permit that you held, because it has been added to the Ineligible List of Occupations for Employment Permits List or it has been removed from the Critical Skills Occupations List and if you are offered the same job by a different employer, then an employment permit application will be considered for the same employment permit type"

Regarding the waiver of labor market test, do I have to get an "EXACTLY" similar profile job role as my previous job to qualify for the waiver of labor market test or am eligible for a general waiver irrespective of the SOC? My previous GEP SOC was 7211. The Ineligible List of Occupations for employment permits list is very confusing.

Has anybody faced a similar situation??

Thanks in advance.

It states that your role is ineligible, but with certain exceptions - I assume you fall under them.

Maybe send an email to DETE and ask?
