Help! I have a few questions!!

Post by phantomjt » Tue May 31, 2005 6:41 pm

Hello friends!

I am soo glad I found this group and hope it will help me and others
out!

Here is my story....
I am a 24 year old Canadian who is currently living in Park City,
UTAH USA with my wife (who is a 25 yr old American).

We HOPE to move to the London England area anytime from September
2005 to no later than January of 2006. When we arrive in the UK we hope to find a place to work for no more than 12 months, then move back to
the Toronto area.

Our issues:
We cannot find the proper work permit or visa to get us both to the UK.

What we have found:
My wife works for the international hotel chain: Marriott Hotels.
She can most likely be transfered to a hotel in the London area if
they company is willing to pay for the work permit fees. Now remember
she is an American.

If she can get the transfer, is there anyway that I could also travel
with her and work in the UK. I doubt the Marriott hotel will hire me
as I do not currently work for them, and they have stated they would
only transfer current marriott hotel employees to a different
country.

Meanwhile, I have found a 'Working Holidaymaker Visa' process online.
I have spend a bunch of cash calling the UK trying to figure out the
loop holes on this visa and have received different answers from each
IND or UK Visa employee each time I call.

Because I am Canadian, my wife American, I have been told the
holidaymaker visa will not work because she is not part of
the 'commonwealth'.

My questions:
1) If she is not approved to be transfered through the hotel what options do we have?

2) If she is approved can I get a spouse work visa? I've heard that because I would be a 'dependant' she may not be approved and we would be stuck here in the USA.

3) What the heck can we do to get to england and work legally for 12
months?

4) Do you know of any company that would like to hire a fellow
Canadian and help him and his wife join the Brits in London for 12
months?

5) Any comments or ideas?

Thanks for listening to me ramble...and I hope someone can shine some
light on this issue for us!

Cheers!

one more thing...

Post by phantomjt » Tue May 31, 2005 7:02 pm

I forgot to add one more thing....

If my wife was to get a transfer to the UK, I am guessing her work permit would be a 'sector based scheme' visa. If I am wrong, please let me know! But her transfer would be to a hotel.

Now from the information found on the IND site and UKvisas.com, a Sector Based Scheme cannot bring depends (child/spouse).

How the heck can I join her and still be able to work?

If her company sponsors her, could I apply for a Workers Holidaymaker visa even though she is american and is already permitted to work in the UK?

Thanks again!
~Jeff

It depends on your wife's skills and the level of the job. If it is Spam and room staff, reception etc. it would be sectors-based and you couldn't come in as a dependant, so the working holidaymaker visa may be your best option.

If your wife is in hotel management, then it would be a full WP. As an intercompany transfer, she could get a Tier 1 WP which doesn't require an employment search. If your wife gets a full WP from Marriott, you can easily come in as her dependant. As a dependant of a WP holder, you can legally work here without restrictions. Once she gets the WP, you can apply at the British Consulate for Entry Clearance as the dependant of a WP holder.
