Post by juliajing72 » Tue Sep 19, 2023 7:32 am

Hello, I have UK IRL but have lived outside UK for more than 2 years now. my BRP card is still valid until 2024. Would I still be able to enter UK using the current BRP card? thx

You lose your indefinite leave to remain if you've been outside the UK for 2 or more continuous years. You may be able to re-enter the UK and get indefinite leave to remain by applying for a Returning Resident visa.

Technically, you can still get on a plane with the BRP if that's what you're asking, as the airlines are none the wiser. However, you might or might not have problems at POE.

So your best option is to apply for a returning resident visa, and avoid unnecessary problems.
No sin in failing, you just have to try and try again!

ILR has no validity or expiry date as it is a permanent status.

The BRP expiry date is simply for the card which is limited (like your bank card), so it needs to be renewed.
Your problem is that ILR status is lost after staying outside the UK for more than 2 years, even if the card has not expired.

You need to apply for a returning resident visa to reinstate your ILR and return to the UK: https://www.gov.uk/returning-resident-visa
Otherwise, you could be refused entry at the border
