ILR Application Time Line

Hello
I have completed 5 years on Tier2+skilled worker route. My visa is getting expired next year in Oct 2024. Can someone please confirm if I am eligible to apply for ILR or Do I need to apply only before 28days my current visa expires?

Visa expiry has nothing to do with ILR. You qualify for ILR within 28 days of completing 5 years of having valid skilled worker visas.

Haven completed 5years, you are eligible to apply for ILR using SET (O).
Some fees and charges increasing 4th October.

I am applying for myself now as my family will be eligible next year. Do I need to mention anything in cover letter to explain about it? Can someone confirm?

You do not need a cover letter. There is nothing wrong with applying on your own

While filling form there is question I am confused with.

Have you previously lived in a country outside the UK including your country of birth?

Is this question about in last 5 years or since birth. I have lived outside India but also had been come UK and went back couple of times as well before I stay continuously 5 years.

I mean I was in UK first time between 2008-2009 then 2010-Apr 2013. However after Dec 2013 I am continuously leaving in UK. Do I need to mention my stay in India since birth and as well as in between 2009-2010.

and
Current Biometric Residence Permit

I assume its same in both case. Please confirm?

Hi Raj, Could you please confirm if they are asking you to submit any residency proof (like tenancy agreement or utility bills) for the whole past 5 years?

If you could provide the list of documents they are asking, that would be great help to me.

Declaration signed by applicant to confirm consent for the Home Office to
request verification checks
Your most recent payslip and bank or building society statement.
These must be dated no earlier than one calendar month before the date of the application. The statement must show the payment, as shown on
the payslip. You should not provide any additional payslips or statements, unless you are currently on
maternity, paternity, shared parental or adoption leave.
If you are currently on maternity, paternity, shared parental or adoption leave, you should provide the last
payslip and bank or building society statement you received prior to the start of your leave. The statement
must show the payment, as shown on the payslip. You must also provide payslips and bank or building
society statements during the period of maternity, paternity, shared parental or adoption leave. The last
payslip and statement must be dated no earlier than one calendar month before the date of the
application.

A document from the sponsor who issued the certificate of sponsorship that led to your last permission to
stay as a Tier 2 migrant confirming that you are:
still required for the employment in question for the foreseeable future, and in the case of Tier 2
(General), Tier 2 (Sports Person) and Tier 2 (Intra Company Transfer) migrants this document
should also contain:
the nearest applicable SOC code which best describes your employment
your current rate of pay (this should be given in the same format as given in the codes of practice,
for example hourly rate or yearly salary), and
confirmation that this is at or above the appropriate rate for the job as stated in the codes of
practice for Tier 2 sponsors. (See note 8 below)
if you are currently on maternity, paternity, shared parental or adoption leave, confirmation of the
date this started, your salary immediately before the leave, and what your salary will be on your
return.

All previous passports, travel documents or national identity cards that you have used to travel to or
remain in the UK


Hi Neha , these are the documents they have requested but I have uploaded evidences of my continue 5 year stay like house deeds/utility bills confirm I am staying here. Try to provide docs as much as you can avoid further queries on application.
