HELP! Representative of Overseas Business Visa Question

Post by kingbrath » Fri Oct 13, 2023 3:33 pm

I am on a Representative of Overseas business Visa since 2019. In 2021 I applied for my first extension a few months in advance as I was told and read the process may take up to 6 months. They extended my visa for 2 years on Dec 6, 2021. Now my Visa is set to expire on Dec 6, 2023 and I cannot apply for settlement until March 29, 2024 as that is 5 years after my initial Visa was issues. Can I just extend my Visa again?

Hard to find any information on this.

Many thanks,
B

You cannot extend your visa again. I am not sure why you decided to apply several months in advance. There was no point in doing so, as simply applying before expiry would have been sufficient. You do not seem to know about the section 3C.

You will be eligible for ILR within 28 days of completing the 5 years, that is March 1, 2024. You need two more months of lawful residence. To achieve that, you can apply for an extension just before the current visa expiry, delay the biometrics for 45 days (but not enrol your biometrics to halt the extension application from being processed), then apply again for ILR (vary the extension application to ILR) and then delay the biometrics until March 1, 2024 to buy yourself lawful residence time for ILR. This way you can secure ILR .

You may ask how is it possible ? Well by understanding the rules: How to apply early and benefit from the date of the ILR decision ?

Thank you Zimba,
Very much appreciate your help with this.

So applying for an extension just before expiry, even if (under my type of visa)I cannot extend my Visa again? not enrolling my biometrics will allow me to extend that time with no penalty? Will I have to pay for both an extension and then ILR?

You face no issues as applying for any application (even if you do not qualify) on its own is totally fine. You can even get a refund for your extension.

You cannot travel at all. If you decide to apply you must remain in the UK until you have your ILR. If you leave, your application will be considered automatically withdrawn

I have read in a few places that it is 240 days to attend a biometrics appointment.

https://visa.vfsglobal.com/khm/en/gbr/your-appointment#

As this is all fine and legal, I assume as long as I have sent the proper documentation with the application that they wouldn’t make a decision without the biometrics?

If you read the link provided on the website, you can see that 240 days refers to applications submitted outside UK.
You're applying inside UK and have different rules.
https://www.gov.uk/government/publicati ... nformation
Individuals who make in-country applications must, in most circumstances, book an appointment to enrol their biometric information within a specified period unless an exemption or exception applies or they have used the UK Immigration: ID Check app. Individuals will be informed to:

make an appointment at a Service and Support Centre (SSC) within 15 working days

make an appointment at a UK Visa and Citizenship Application Services (UKVCAS) location within 45 working days
Not a qualified immigration adviser. Use links and references given to gain confirmation and/or extra information.

Thank, you. How do I know if I will have 15 days or 45??

Only applicants under very few visa routes are required to go to a Service and Support Centre (SSC). You will be notified if that applies to you. The reset of the applicants will be asked to book via UKVCAS or submit their details via the APP.
