Hi,

Apologies for asking a silly Q.

Does visa expiry on an entry clearance spouse visa refer to the expiry date of the BRP card?

I want to know when I can apply for FLR. I entered UK on 2 June 2021. Can I apply 2.5 years (30 months) 01/12/23 after this date minus 28 days which is 03/11/23?

Or do I need to wait until 28 days before the expiry of my BRP card which is 15/01/24.

Eligible to apply 28days before completing 30months in the UK counting from date of entry into UK on initial spouse visa.

Read again: eligibility is not in reference to expiry date but to entry date.
From the date you are eligible up to the expiration on your BRP or the letter that accompanied it is the window you can use to apply.

Further to advise already given, the last date you can apply for FLR is the expiry date on your BRP "in your case". For some it might not be. Because their right to stay in the UK might extend beyond their BRP expiry date.

Please note that all BRP's might cease to exist at the end of 2024. Since your expiry date, based on issue date, is much earlier than that, that's when your right to stay in the UK ends.
