Reconsideration request - unclear email form Nationality Reconsideration Team

Post by Ali25 » Fri Nov 17, 2023 3:40 pm

Hi all

I applied for a reconsideration of my naturalisation application which included my son. I spoke with the immigration lawyer and she confirmed that I could submit one request and payslip as we have the same application. I proceeded on this basis and sent them one request form and payslip for myself only.

However, I have now received an email from Nationality Reconsideration Request stating the following:
I refer to your recent correspondence (enclosed) asking that we review the decision to refuse your application for British citizenship. We are unable to consider this request for the following reason(s):
- You have not completed the relevant application form (form NR) (Each Applicant)
- We have fee slip for DC payment (£372 per applicant) (Each Applicant)
The ways in which British citizenship can be acquired are defined in the British Nationality Act 1981 and the regulations made under it; these can be viewed at www.statutelaw.gov.uk.
How we consider and decide an application for British citizenship can be viewed on our website at www.gov.uk/uk-visas-immigration. Where individual circumstances are not precisely covered by our instructions and there may be scope for exercising discretion beyond this, we will consider an application on its merits and with reference to agreed precedents or, in especially compelling cases, by creating a fresh precedent where this can be justified. An application which is not covered by our instructions, is not matched by agreed precedents and does not justify the creation of a new precedent, must be refused.
As the requirements for citizenship were not met, we considered the exercise of discretion to overlook this, both in line with our instructions and agreed precedents and by considering the individual circumstances of the case with a view to creating a fresh precedent, but could not find sufficient reason to do so. The application was therefore refused.
There is no right of appeal against our decision to refuse the application but if you believe it is incorrect, you can apply for it to be reconsidered by completing Form NR. A fee of £372 per applicant is payable for reconsideration and should accompany the application.
If our decision is reversed and the application is approved, the fee will be used to cover the cost of a citizenship ceremony, where applicable, or refunded. If our decision is maintained, the fee will be retained to cover the costs of reviewing the application.
Please find new payment slip attached.
As of now, I have completed the form NR and payslip for my son and sent the scanned copies of those back to the same email address and asked them to let me know if you they require anything else. But I am not sure if they reply to emails.

I am still a bit confused as I am not sure what exactly that email means. Did they just request those documents or simply rejected my request? Shall I also send the original of my son's form and payslip to them separately or make a new whole request and attach two NR forms and payslips? Shall I expect any reply to my email?

Grateful for your views if you have/are aware of any similar situation.

What were the exact reasons given for refusal of your AN application and your child”s MN1 application? What you quoted relates to the NR application.
What has your solicitor advised?
Did you just write a letter?
It’s important to understand the full background before anyone can comment on the merits of reconsideration .
This is just my opinion as a member of this forum and does not constitute immigration advice.

Thanks for your reply. Sorry if it was not clear, but my query was indeed related to the NR application. I am not seeking advice on the merit of reconsideration but rather on this particular email and what it means in terms of the process. Basically I outlined my questions in the post. I am new here and if you think it can be posted somewhere else, grateful if you could let me know.

NR application isn’t really a common application discussed here widely, or anywhere for that matter.

The email basically says you have to apply using the form. Which makes ask how did you apply in the first place.

More importantly why were your original applications refused? That could give us pointers how you could approach, or whether reconsideration is advisable.

Down to you to decide what you want to share.
