
- I am a UK national.
- My fiancée is a US national.
- I am working, she is a Med student.
- We met in summer 2007 and since then she has visited me here (UK) twice - including spending 3 months here this summer - and I have visited here in the US once. I am going there for a couple of weeks around Thanksgiving and she will be coming here again for Christmas. We speak - in some form - every day and have lots of evidence of our relationship. She has met my whole family and I have met some of hers and will meet the rest of them at Thanksgiving, both families know we are engaged.
- Due to her course commitments in the short to medium term we will need to be living in the US.
- We were going to get married in the UK at Christmas, but due to the ineptitude of the UK authorities (long story) we were unable to get either a Fiancée Visa or a COA.
So, we are thinking about where we go from here and there are 3 options, as far as we can see:
1. Apply for a UK Fiancée Visa, give notice at Christmas, get married in the Spring and then apply for a K-1 visa for me to go to the States.
2. Apply for a US Fiancée Visa, get married over there, I come back here and apply for a K-1.
3. Apply for a US Fiancée Visa, get married over there and I stay there and apply for a change of status and permission to work there.
Judging by how long it seems to take for a K-1 to come through, our preferred option is now No.3, but we've only just found out about it and so if anyone can help me with some advice about what to do that would be most appreciated.
Also are there any things that I need to know that might not be obvious, like whether or not I can leave the US, and if so how long for, whilst my residence is only temporary, and so-on?
Does the 90 days start from the day the visa is granted or the day I enter the US on it?
How long does it take fro them to process the Fiancée Visa? Basically, it seems like about 8 months judging by here: https://egov.uscis.gov/cris/jsps/Proces ... Center=VSC
Am I correct that, when it does come through, I pretty much need to be able to drop everything over here and move over there, get married and sort out all the paper work, within 3 months?
Is there anything I've missed out? General stuff like what I have to do to tie-up loose-ends here, government stuff, etc.
