Spouse visa extension questions

Post by Arksba » Mon Nov 27, 2023 12:01 am

Hi all,

My partner arrived to the UK in October 2021 and the time for her renewal is drawing nearer however I am uncertain on a few things which if you can kindly help me on:

1. My wife and I do not hold any joint bills together but she has a mobile phone sim only plan showing our address as we live at our parents house, and a bank account to which she receives pay from her part time job. Also she has various letters from NHS - is the mobile phone plan & bank statements enough proof on her side to complete as proof of address? If not what would you recommend?

2. Is a B1 english certificate much different to the IELTS exam and does my partner need to practice for this as she speaks decent conversational english? Or would you recommend just booking the exam without any preparation? Also are there any other certificates needed as I saw on this form a LIUK test is also needed?

3. As I will be starting a new job soon but not sure if I will like it, what is the best course of action in terms of gathering payslips from the new job to the one I currently hold? Will I just need to show continuous payslips for 6 months regardless of the amount of jobs?
Also if I leave the job within the next 6 months and cannot meet the pay requirements, I have a savings account in my name that was opened in June/August 2023 with over 50k in savings. Is this a viable way to meet the financial requirement?

Sorry for the long questions I have been having bad headaches about these few things if you can kindly help me on!

You need to provide 6 letters for each of you I.e. total of 12 letters covering last 2years, spaced 3-4months. Any item of correspondence showing name and address vmcan be used.

2. Is a B1 english certificate much different to the IELTS exam and does my partner need to practice for this as she speaks decent conversational english? Or would you recommend just booking the exam without any preparation? As you have use the words "decent conversational" let her practice well. What does she hold at the moment? Check for B1 SELT GESE from Trinity College London. Also are there any other certificates needed as I saw on this form a LIUK test is also needed? LIUK is different; for ILR and naturalisation.

3. As I will be starting a new job soon but not sure if I will like it, what is the best course of action in terms of gathering payslips from the new job to the one I currently hold? Will I just need to show continuous payslips for 6 months regardless of the amount of jobs?

Is this a viable way to meet the financial requirement? Yes If upto £62,500 and held in the account for at least last 6months and not falling below the savings financial threshold in the period of last 6months. Category A - last 6months income evidence with same employer required.
Category B - At least 1 month income evidence from new employer + previous evidence of income from previous employer all totalling previous 12months and meeting minimum threshold of 18,600.

I don't think my wife has six letters spaced 3-4 months apart, possibly about 4. Will it still work?
Apart from her IELTS when she first came to the UK, no further qualifications. Are there any practical materials online?
When you said upto 62k, what happens if I have more than this in the account?

By the way thanks so much for your help :)

Apart from her IELTS when she first came to the UK, no further qualifications. Are there any practical materials online? Yes, you can get on YouTube and when you register with TCL, you can get link to materials.
When you said upto 62k, what happens if I have more than this in the account? Minimum is 62.5k, more is always better of course

By the way thanks so much for your help :)

It should still work. She can supplement with Bank statements and NHS letters if you have.

There's always materials online for everything.

Even better, It's £62.5K, and this should be the minimum for the last 6 months prior to the application. No maximum!
No sin in failing, you just have to try and try again!

some notes on letter Letters; Mobile phone bills are not accepted.
Landline phone should be ok. Sky TV/Netfilix etc are NOT accepted. BBC TV license accepted (mailed paper statement or license only)
If there is time I'd transer one or two utilites to her name. The good thing about utilities is that online PDF bills are generally accepted as long as they show the name address and some kind of usage of water/electricity/gas.

Tv license in her name (but ensure they send out a paper license confirmation) Bank account statements or bank communications posted. Letters spaced reasonably apart for applicaton time. like 1 or two from nov/dec 2021, 2022 and the rest from 2023 and just until just before (but not after!) you pay for the FLR. This is not super strict but try spread out ie not all of them from the same time.

You can add her name to the council tax (so it is a joint account) and go to the council and ask for a confirmation print out or letter posted showing the council account status.

For the salary/savings people have given good replies just an emphasis that if you use income from salary, you can combine her salary too if she happens to work. Category B should have 12 payslips*, employee reference letters (old and new job!), signed contract (old and new jobs) P60s are optional but if you have them, use them.
12 months of bank statements either posted from bank, generated in a branch or online PDF statements with bank logo, your account number your name and home address. (Printouts of the webpage and screenshots are not accepted) for online, you must use the PDF scanned paper statements. )

*the 12 may not be an absolute requirement but is expected, less than 12 payslips and the application may be delayed or adversely affected/higher risk of refusal.

There is no strictness on evidence of cohabitation. AFAIK no one has being denied or refused for not providing exact numbers required or for spacing/interval desired.
Provide what you have to best of ability.

correction on bank statements; (Printouts of the webpage and screenshots are not accepted) for online, you must use the online PDF generated for download OR scanned paper statements. )
Sky bill or supply of service confirmation may actually be ok provided it shows the name, address and account number and is posted paper statement but I am not sure on this one.

28day before completing 30months is UK counting from entry into UK on initial spouse visa.

Technically for renewal, there's no earliest, and the latest is the day before her visa expires.

Advisable would be sometime in April,2024 at the earliest.
