You can use company A job creationHappyChap2021 wrote: ↑Tue Nov 21, 2023 9:55 amDear All,
I am T1 entrepnour route, got my extension august 2022 by applying with company A.
Company A operated for 1 year after extension with one employee until september 2023.
Company A will close due to bankrupcy, and will establish now company B.
question;
by the time i apply for ILR september 2024 in one year: can i use the employee from company A who was on the payroll for 12 months so i need only to hire one employee for company B for 12 months?
or company A can not be used to apply given the company will close and i have to hire 2 full time employees for company B by the time i apply?
thanks for all in advance for any help.
thank you marcnath for your usual prompt help. so even if company A will seize to exist by the time i apply, i can still use the job that was created for one year to add to the other job from company B?marcnath wrote: ↑Tue Nov 21, 2023 10:04 amYou can use company A job creationHappyChap2021 wrote: ↑Tue Nov 21, 2023 9:55 amDear All,

Yes. There is no requirement that the company needs to be operational at the time of applicaitonHappyChap2021 wrote: ↑Tue Nov 21, 2023 10:24 amthank you marcnath for your usual prompt help. so even if company A will seize to exist by the time i apply, i can still use the job that was created for one year to add to the other job from company B?marcnath wrote: ↑Tue Nov 21, 2023 10:04 amYou can use company A job creationHappyChap2021 wrote: ↑Tue Nov 21, 2023 9:55 amDear All,

Each job has to be 12 months. So you will not be able to use the employee with 11 months at all.
Yes, it canHappyChap2021 wrote: ↑Sun Dec 03, 2023 11:01 amlast question on this ( i promisemarcnath wrote: ↑Sun Dec 03, 2023 10:51 amHappyChap2021 wrote: ↑Sun Dec 03, 2023 10:47 amjust noticed that the employee had 11 month on company A that was closed. can i still use the time he spent? and use 13months for an employee on company B? or it had to be 12months to be countedmarcnath wrote: ↑Tue Nov 21, 2023 11:08 amYes. Each job has to be 12 months. So you will not be able to use the employee with 11 months at all.: so if in company A i had an employee that did 11 months on the JOB and then another employee did one month on the same job, it still can count ?
We found out that there was a gap of 3months between the first worker who did 11months on job left and the new employee (who worked for one month joined) does this still count? I mean does HO view this break of employement with negative eyes?marcnath wrote: ↑Sun Dec 03, 2023 9:10 pmYes, it canHappyChap2021 wrote: ↑Sun Dec 03, 2023 11:01 amso if in company A i had an employee that did 11 months on the JOB and then another employee did one month on the same job, it still can count ?marcnath wrote: ↑Sun Dec 03, 2023 10:51 amHappyChap2021 wrote: ↑Sun Dec 03, 2023 10:47 amjust noticed that the employee had 11 month on company A that was closed. can i still use the time he spent? and use 13months for an employee on company B? or it had to be 12months to be countedmarcnath wrote: ↑Tue Nov 21, 2023 11:08 amYes.
