Irish citizen marrying undocumented (based in EU)

Post by grashive » Thu Jan 04, 2024 10:14 am

Hi all,
I am an Irish citizen living in EU, in a relationship with an undocumented Egyptian man. I have been looking at the spousal visa process online, and while I satisfy most of the criteria, I am unsure whether he needs proof of residency in France to then apply to Ireland. He has an Egyptian passport. Also, I am trying to establish if my proof of income/bank alone is enough, or if I should attempt to apply for a joint bank account.

I am aware the website states 'all' this information is required but I am wondering if it is looked at more subjectively by the immigration officers, as we can very much prove our relationship and my financial situation/proof of address etc. To be specific I am referring to the Spouse D application as listed here.

Anyone in this situation able to advise?

many thanks
G

He would be asked for a document to show his legal stay in France, most likely.

Why do you want to go to Ireland? You'll have way more leniency in France due to EU Treaty Rights, which don't work in your country of nationality.

I live in Ireland normally, I was just in France for work. Not sure on EU Treaty of Rights.. will have a look but the system in France appears to be much more complicated on first glance.

Hi Meself2, just replying again. From what I've briefly read, essentially he would have the same rights to apply legally etc, through me, based on my rights as an EU citizen? Thanks.

First of all, are you married already or is it a possibility?
Ireland requires permission from ISD to marry; not sure about France.

EU regulations (if EU citizen doesn't live in their country of origin) are way less stringent compared to EU citizen in country of their nationality, as national rules apply - for example, Irish citizens in Ireland have minimum income requirements.

Hi again,

We are thinking about marriage. I've just checked, and yes it looks like it will be more straightforward in France if I exercise my rights there and he can continue to apply for residency - which would eventually allow him to join me in Ireland as he would be documented. Thanks for that little piece of information. :D :D
