SET(M) - ILR Family route - Question about payslips/proof of employment

Hello everyone,

My wife is eligible to apply for Indefinite Leave to Remain (ILR). She is currently on a spouse visa (family route) and has all the necessary paperwork to apply for ILR. She is currently employed by the NHS. I have a question regarding proof of employment/payslips.

My wife was working at a hospital from September 2022 to July 31st, 2023. She then joined a new hospital in September 2023 and is currently working there full-time. In this scenario, I understand we need to submit 12 month bank statements and payslips.

However, her previous employer did not remove her from the payroll until September and paid her salary for August and September. She notified the employer about the error in August and repaid the additional payments in December once an invoice was issued by the payroll team. We have all the emails confirming the error, invoice from the payroll, and bank transfer confirmation of returning the amount.

Do we need to explain this in a cover letter when she submits her ILR application? Also, do we need to submit those payslips (for August and September) as the amount appears in the bank statements? Is there any other additional documentation we should provide in this instance?

She applies under category B. She must satisfy the requirements in two parts:

1) Her annualised income from her most recent job should be above the threshold (£18,600+)
So all salary earned in your most recent job divided by the period in which it was earned, then multiplied by 12 must be above (£18,600+)
AND
2) In the last 12 months, she has earned in total, at least the minimum salary needed (£18,600+), so all income earned in the least 12 months from any job held

She should only submit the correct payslips and ignore the ones issued in error.
