Hi guys! I am new on this forum. I would appreciate your guidance on this matter. The urgency lies in the impending expiration of my visa. Your expertise would be precious in this situation.
I am writing to address the significant disruptions I have encountered during my master's course due to the strike action at the university.
Being an international student, my commitment to this academic pursuit has entailed considerable financial investment and personal dedication. Unfortunately, the strike, especially the involvement of my dissertation supervisor, caused substantial disruption, profoundly impacting both my mental health and academic performance.
The uncertainties surrounding the strike and my active participation in the boycott resulted in severe anxiety, making it exceptionally challenging to concentrate on my studies. Throughout the strike period, I diligently communicated my concerns and challenges through appropriate channels, supported by documented evidence and a medical statement from my general practitioner outlining the extent of distress and anxiety I endured.
This prolonged stress and uncertainty directly contributed to a shortfall in achieving a passing grade by a mere five marks in one of my modules. Despite filing an appeal to the university to address these adverse circumstances, the provided deadline for the appeal outcome, 23rd January 2024, significantly aligns with the expiration of my student visa on 30th January 2024. I am deeply troubled by the lack of attention given to my concerns.
Considering the urgency of the situation, I am contemplating two potential courses of action to ensure timely resolution:
Visa Extension Consideration (FLR Visa): Considering the imminent expiration of my student visa and the pending appeal outcome, I am contemplating applying for a Further Leave to Remain (FLR) visa to ensure legal continuity and allow ample time to resolve the appeal process.
Legal Recourse Against the University: While I am hopeful for an amicable resolution through the university's appeal process, the severity of the situation requires contemplation of legal action as a last resort to address the impact of the strike action on my studies and subsequent academic standing. Please guide me on how I should go about it.

You have a Student visa that is valid until 30 January 2024, which is a week after the date for your appeal outcome. I assume the appeal decision date of 23 January 2024 is deliberate, to allow you to extend your Student visa if it is successful.

Presumably the ideal outcome of the appeal on that day is that you will be sponsored with a new CAS for a new Student visa to continue your studies, with a re-take or repeat of the module.

It seems that it could go one of four ways:

(a) you will be sponsored for an extension of your Student visa; or
(b) you will be sponsored to return to the UK to complete your studies after an interruption; or
(c) you will be allowed to complete your studies but from your home country without Student visa sponsorship; or
(d) the appeal does not allow you to continue your studies

How does an application to remain in the UK outside the Rules, which is what I assume you mean by "FLR visa", come into any of those outcomes?

I am sorry to read about your situation. I hope you have received a positive outcome today.

Sah10406's is right with the 4 options.

My nephew is in a different, but slightly related situation.

He appealed and the outcome was successful and is still waiting to know if he has option a) or option b)
Preferably option a) but time is running out for us.
Option b) would be problematic for us, because if has to return on a visitor visa, then it is not clear if he can switch from visitor to PSW, etc.
