Should i Extend my spousal visa or apply ILR

Good Afternoon,

I have a small query so was wondering if one can help please. I would like to know if i can apply for ILR or extend spouse visa. Here is my little summary:-

I came to the UK on Nov 2015 as a Tier 2 Dependent.

2018- extended my tier 2 Dependent visa valid till 21-08-2021.

2021- applied for FLR M spouse visa on 15/08/2021 granted till 28/03/2024.

Just to let you know My partner was granted ILR on 29/01/2021(10 year route)

Therefore my Question is do i have to extend my spousal visa for another 2.5 years or apply for ILR. When do i actually qualify to apply for my ILR?

10 year legal stay route to ILR would be Nov 2025
5 year spouse visa to ILR would be Aug 2026

Extending your spouse visa is your only option unless you switch to another visa route

Hi Everyone,

This forum has been very helpful for people like myself. So thank you very much to each and everyone for your input.

I am extending my spouse visa flr fm as i have mentioned on my previous post. While doing the Application, i am stuck in this particular question:

Has your partner lived anywhere other than your current address during the past 2 years that you have not already entered on this application?

My wife went on holiday abroad(back home) for 5 months while she was on her maternity leave. Do i have to mention this too?

I look forward to receive advice on this like always.

Hi,

I do have one more question.

Can i apply for my spousal visa extension before 28 days of my current leave expiry? My visa expires on the 28/03/2024. Can i apply before the 6th of february to avoid paying increased Ihs fee?

Will this affect my current application and have complications while i apply for ILR after 2.5 years?

Please kindly advise.

You can apply before the expiry at any time you wish. Normally it would not be wise or sensible because it would require yet another visa extension to get to the 5 years for ILR.
Assuming you are going for 10 years legal stay in November 2025 then this will not have an impact.

The questions asks about where you "lived", not where you holidayed.
No sin in failing, you just have to try and try again!

The question asked about "lived", not about where she stayed while visiting hone country for holidays/maternity leave.

The answer is NO. The permanent residence still remained in the UK

I have few more query regarding my spousal visa extension. I would really appreciate if you can provide feedback on this.

1) The current salary threshold of 18600/year is met by mine sole income. Do i have to provide the additional salary of my Mrs too?

2) Is this the first time you have applied for a partner route, or an extension, with your current partner (including as a fiancé(e) or proposed civil partner)?

My ans:No

ChangeExtending or switching to a partner route
3) Please choose the reason you are applying for an extension, this includes if you are switching to a partner visa from another type.

a) First extension as a partner (following an initial period of entry as a partner, or as a fiancé(e) or proposed civil partner of a settled person)

b) Additional extension as a partner

c) First application as a partner from within the UK (for example, you are currently in the UK on another type of visa or permission to stay)

d) You delayed your travel to the UK by more than 3 months after the issue of a visa and have not yet completed the required amount of time on a partner visa (not including as a fiancé(e) or proposed civil partner)

e) You require more time to meet the Knowledge of Language and Life in the UK requirements to apply for settlement

f) You were granted entry as a fiancé(e) or proposed civil partner, but have not yet married or entered into a civil partnership

g) You are applying for any other reason

Your salary is enough in its own right. No need to provide your wife’s payslips

Correct - answer is No

Just making sure - this is your spouse’s first extension under spouse visa - if yes then it would be 3a)
