Naturalisation query for my daughter born in the UK but held Indian passport for emergency travel

Post by NavAsh » Wed Jan 17, 2024 1:44 pm

Hi,
I need your assistance in the below matter please,

My daughter was born in the UK (2020), and eligible for British passport at the time of birth as the parent had the Indefinite Leave To Remain at the time of her birth.
During covid we had to travel on emergency to India hence choose to apply for Indian passport instead of waiting for British passport and OCI card, which would have taken a long time during Covid.

After the return from India, we applied for her British Passport and got it in a week( without naturalisation as she was directly eligible for British citizen).

Now we have an application for her OCI card with the high commission of India London.
My question is since she held an Indian passport, is there a need for naturalisation certificate for OCI card application purpose.

Do we need to submit a surrender certificate from naturalisation for her OCI card application is my question.
Help is greatly appreciated.

Thanks

OCI is a separate process, for Inda only, nothing to do with naturalisation. Ask in the "Other Countries" forum: other-countries/

British child cannot obtain a registration certificate as she was British by birth!
There's also nothing to surrender "from naturalisation".
This is just my opinion as a member of this forum and does not constitute immigration advice.

You will need a surrender certificate for giving up Indian passport. Once obtained, your child will to renounce her Indian citizenship and obtain a certificate for that. Both of these are needed for OCI.

You should ideally call the High Commission and explain as they can accept surrender only in exceptional circumstances.

If both parents have applied for British Citizenship and formally renounced Indian one, then the children also automatically lose theirs, whether they applied or not. So might be worth waiting and applying for OCI together.
