OCI Application after applying for UK Citizenship for spouse and kids?

Post by SMAK » Thu Jan 18, 2024 2:03 pm

Hi. I have been delaying my citizenship application for the past 3 years out of some vague reluctance to give up a nominal card. However, one thing I had hoped to accomplish before I either renew my Indian passport or apply for UK citizenship is to get OCI for the husband and children. Husband is British, not a person of Indian origin. His connection with India is me. And his many visits there now. But twice they have said we have not submitted the right thing. They also told my husband we had to both arrive together - wasn't clear on the website but hopefully I'll get it right this time.

Anyway, it's now time to either renew my Indian passport or bite the bullet and get the British citizenship.

HOWEVER

If I now apply for UK citizenship, will that make the OCI process harder for my husband? Can I still apply for his OCI after I become a UK citizen?

It is generally more difficult to get OCI for those who are not ethnic Indians (just stating the facts, not my rules). Best would be to apply for their OCI and then apply for your citizenship. There will be fewer documents to provide.

Also, with you still being Indian, there is strong case for OCI for your family to be granted without too many queries, as its apparent they will accompany you.

You have a few presumed rights as a citizen. Once you are not, you cannot avail of some consular resources which can help in your family's OCI application.

You have already experienced the document issues twice, being told to arrive together etc etc. (There is no such rule though FYI). This is when you are still a Citizen. Imagine the hurdles when you are no longer one.
