BRP expiry prior to 5 years stay in UK

Post by VRKBP » Sat Jan 20, 2024 4:18 pm

We came to UK with General tier 2 visa. Our BRPs are getting expired in 70 days prior to completion of 5 years stay in UK to apply for ILR. Are we eligible for applying for ILR? I think 28 days short for 5 years only eligible as per general guidelines to apply for ILR. Is there any way to get ILR without extending the Visa for an additional year. Could any one help me the way forward, please? Thanks in advance!

State the dates associated with your initial visa approvals, visa vignette grants and BRP.

Thanks for the prompt response. Please see the dates below
Work dates in Certificate of sponsorship: 03 Jun 2019 to 02 Jun 24
BRP issue date: 01 Aug 2019
BRP valid until date: 16 Jun 2024
Arrived in UK: 24 Aug 2019

Dates as Valid from and valid until on Entry clearance sticker (UKVI01) placed in our passports (vignette): 15 Aug 2019 and 14 Sep 2019 respectively.

Unfortunately, I don't know about the initial visa but, there was a letter with heading of UKVI01 from UK Visas and Immigration which states in 1st paragraph as '.....when you arrive in the UK you will have permission to enter as Tier 2 (General) Migrant from 15 Aug 2019 to 16 Jun 2024.

Kindly let me know for any additional information, if required.

Regards,

Apply before visa expiry, apply using standard visa service and delay biometrics for up to 45 working days. It all will work out as explained above

Thanks Zimba for advising to read the previously shared link to understand, missed to check the link earlier. Based on the reads of your posts and my understanding, we can apply ILR instead of extending the visa as per plan below;

Submit ILR application on or around 29 May 24 (19 days prior to the BRP validity until date of 16 Jun 24) using standard visa service
Biometric date shall be on or around 30 Jul 24 by delay ing biometrics for up to 45 working days (still we will be short of 26days for 5 years stay in UK. I think 28 days shorter is also okay!
Could you please correct if my assumptions are wrong? It would be a great help, if you can advise.
Regards,

Hi BRKBP,

Please let me know if this option worked out for you as I am in the exact same situation as you are, however my BRP is expiring by Sept 2024 and I started off by June 2019. Thanks in advance.
