Financial requirement - Self employed switched to employment

Post by Shakoo » Sun Jan 14, 2024 8:24 pm

Hi, I am applying for my wife's ILR on 5 years route. I started a job only 3 months ago and the Gross Salary is over £18600, before the last 3 months I was self-employed and my self-employment earning was also over £18600. I have 2 questions:
1- Under what category do I fall to prove that I meet the financial requirements
2- What proofs do I need to support the self employment part which was only until Lat week of October, right after which I became full time employed in a company.
Would appreciate the detailed answer please.
Many thanks

Under category B, your employment income cannot be combined with any self-employment income at all. You must also satisfy the income requirement in two parts under category B. Your current annualised salary should be at least £18600 AND you should have earned at least £18600 over the last 12 months (from employment). You have not earned £18600 from employment over the last 12 months, so you will face issues here.

Under category G or F, your self-employment must be ongoing or else you will not qualify under this category either. You also cannot just claim self-employment on any period, you can only claim money earned within a tax year and must provide your self-assessment for that period

All of this is explained in the guide: https://assets.publishing.service.gov.u ... rement.pdf

Hi, thank you for the answer. Is there any way round? I have self employment income for last financial year over £18600 but that self employment is not ongoing at the moment means I haven't invoiced anyone in last 3 months but I am still registered as self employed, Also, after the last financial year for 7 months Until October I have earned ( from self employment ) a good income and that should count in income somehow.
Is there any option for me?

I suggest reading the guide very carefully !! You could rely on cash savings as that is an option too
Evidence of ongoing self-employment through the provision of at least one of the
following: a bank statement dated no more than 3 months earlier than the date of
application showing transactions relating to ongoing trading, or evidence dated no
more than 3 months earlier than the date of application of the renewal of a licence to
trade or of ongoing payment of business rates, business-related insurance
premiums, employer National Insurance contributions or franchise payments to the
parent company
