General Work Permit refusal

Hey guys,

My general work permit application got refused on the basis that my job in on the Ineligible List of Occupations.

I have spoken with two lawyers who gave me completely opposite opinions on the matter. My question is, should I bother with the appeal or is it easier to apply under a new role? If so, in what way should we rephrase the job description to avoid another refusal?

I work for a mental health startup, I'm not from the EU but I speak Dutch.

Here is the job description:
- Source and recruit Dutch-speaking Professionals in Belgium and the Netherlands among different specialities to partner with (company name)
-Educate and set up new and existing professionals to ensure they understand the (company name) software and solution.
-Run diverse campaigns to drive awareness and sign ups from our professional network.
-Manage our CRM and other platforms related to driving sign ups.
-Collect and analyze customer data, to better understand customer needs, viewpoints, and improve professionals’ experiences with (company name) products and services
-Ensure that professionals have a full set up and are ready to use (software). Support technical enquiries from our professional network with the highest standards of customer experience.
-Conduct regular reviews with professionals to ensure they are satisfied with our product and services.
-Develop outbound campaign flows to drive subscriptions and interest from the various professionals.
-Identify and analyse best sources, lists or professional bodies that will help us drive awareness about (company name) services and encourage professional’s participation.
-Become an expert on how our professionals will benefit from using the (company name) platform.
-Help to identify and resolve challenges with product adoption encountered by our professionals.

What SOC code was stated in the letter and which one did you aim to use?
You can use https://onsdigital.github.io/dp-classif ... _tool.html as an example.

You'd also have to explain why your definitions change drastically if you want to appeal and plan to change job description.

The letter of refusal just stated the following:

It appears from the information received that the position on offer is for an employment specified in regulation 29(1) and Schedule 4 of the Employment Permits Regulations 2017 (S.I. No. 95 of 2017) for which a General Employment Permit shall not be granted. Please note that the occupation in question is on the List of Ineligible Categories of Employment for Employment Permits. In line with section 12(3) of the Employment Permits Act 2006 (as amended) an employment permit cannot be issued.

I was aiming at: 3545: SALES ACCOUNTS AND BUSINESS DEVELOPMENT MANAGERS

Yes, of course I understand that I can't change the job description for the appeal, but I will probably have to to lodge a new application
