ILR-Dependent Child over 18

Post by rguljee » Sun Jan 28, 2024 3:29 am

I am on T-2 General visa and first entered in UK Feb 2019 alongwith my family as dependent. Now my child turned over 18. However, he is still dependent; single and living with me.

Q1. Can I include child over 18 in my ILR application set(0) as per https://www.gov.uk/indefinite-leave-to- ... ly-members

Q2. The link says at the bottom that child has to pass live in UK test and prove english language but while filling the above form set(0) does not ask any question about life in UK and english language?

Q3. Does it applies continuous 5 years condition?

Q4. If all above does not apply to child over 18, which online should be used?

Urgent reply/advice requested.

Thanks

RG

Old UKVI forms suggest that a separate SET(O) form should be used for the child. LIUK and English language requirements apply but there is no residence/absence requirement

Thanks for the reply. for child over 18, LIUK and English language requirements apply but it does not ask while filling the form for the child. How to provide LIUK and English language in that form?

The form assumes they are under 18 and will not ask.
As I suggested, as separate SET(O) application should be used for children above 18 :!:

Hi!

I'm in the same situation. What did you decide to do? Did you apply for your son separately or include him in your application and added his LIUK and English test results to your documents? Thank you!

There is no difference. The suggestion is to apply separately for those over 18s

Thank you for your answer. Ok, I will apply separately. The system asks: In which category are you applying for ILR? Personally, I am going to apply for Representative of an Overseas business category. But which category should I choose for him if I fill out a new ILR application?

"Adult Dependent Relative category" seems not appropriate. Maybe "Other purposes or reasons not covered by other application forms"?
