Tier 1 Dependant joining in the UK before 12 months

Tier 1 Dependant joining in the UK before 12 months

Hi,

My wife has got a Tier 1 Migrant visa valid till Sep 2011. At the time of making her application, we stated that I wont be joining her as her dependant before 12 months and hence the maintenance of funds was shown in her account accordingly. Now I wish to apply for a Dependant visa before 12 months . Can I do it or do i need to wait until 1 year gets over and then join her as her dependant.
It would be great if someone could assist me on this ASAP.

You can very well do it now. Make it clear in the cover letter though. Additionally please ensure that both of you continue to meet the maintenance fund requirement. It should not be the case that because of paucity of adequate funds the main applicant got approval first and thereafter once the approval was granted the same funds are used for meeting the maintenance fund requirement for the dependents.

Hi dude,

Thanks for your quick reply. I will tell you my exact case.
At the time of applying for her visa, we stated that no dependants would join her in 1 year. Well the case was true because I came to UK on a on a Work Permit. I have my WP valid for 2 years until 2010. But now I have to go back to my country (India). Now I wish to come to UK again as her dependant in the next 3 months. Can I show 2800 + 1600 pounds equivalent INR in my account only (not a joint account) and apply for a dependant visa after the 3 month period for maintenance of funds.
Secondly what all supporting documents would I need apart from the ones mentioned below :
1) 3 months bank statements
2) Letter from the bank for maintenance of funds
3) Marriage Certificate
4) Wedding Invitation Card
5) Wedding snaps
6) Cover Letter
7) Supporting letter from the main applicant

Any thing else if I have missed.

Read it carefully mate - The requirement still remains 3 months for out of UK applicants its just that the statements can now be as old as 30 days (instead of 7 days) when you submit the application.

HI Balaji,
it seems you are getting confused about the maintenance funds.
you still need to show the maintenance funds in your account for 3 months.
the change in rule is for the evidence that can be dated upto one month.
previously the evidence ( bank statements ) should not be older than 7 days by the time you are applying.
