Tier 1 extension - Dismissal in previous company

Post by ramesh.78.kumar » Tue Dec 30, 2008 12:35 pm

Hi,

I have been dismissed from my previous company (X) for a very minor misconduct. However no civil judgement passed against me. I am currently working in a new company(Y) and planning to apply for Tier1 extension in Jan 2009. For earnings, I would be providing the pay slips from previous company(X).

Please let me know if I need to mention about my dismissal in Tier 1 extension form - declaration section.

Regards
Ramesh

Just to explain it little better. I took a sick off day off to do some personal work and the company managed to find it out with evidence. Based on this a disciplinary action taken against me and i was dismissed. This was handled purely from my company and no court proceeding were involved.

Please let me know if this comes as part of criminal/civil offence. Do i need to tell this info in Tier 1 extensio form.

I would really appreciate response from the forum in this regard.

Ramesh

If the company or you did not take it to civil or criminal court and the same was not reported to any law enforcement authority and it was not taken to a service tribunal then it would definitley not count as a civil/criminal offence. It was a simple case of breach of service(employment) contract between two parties who sorted it out between themselves. You need not mention it in the Tier-1 application.

Thanks push_hsmp for your response.

In my case, no one except me and my employer were involved in the disciplinary action.

I think even if this has been taken to court, unless the court has ruled or passed any stricture against you, this may not amount to any offence requiring mention in the application.
