British Citizenship - Absent for more than 6 months

Post by geliowind » Wed Mar 27, 2024 3:11 pm

Hi dear experts

My story is as follows - I obtained my ILR back in June 2023. Since then I travelled outside of the UK for 2 months between August and October. However now, I need to care for my ill relative in my home country, I flew here in the beginning of February and I expect to be here for another 5-6 months until September/October. Route to ILR is Skilled Worker Visa.

I have counted my absences in the previous 5 years and they total around 120 days. Given the threshold of 450 days in the last 5 years, I do have another 330 days to spare but is the fact of me being absent for longer than 6 months at one time going to cause an issue if I come back in September, wait until my absences for the last 12 months fall below 90 days and apply for naturalisation?

Thank you for your help in advance

Your absences in the last year should be under 90 days. You can ask for discretion if they are up to 180 days, but anything over that would be an immediate refusal.

There are to parts to the absence requirements, your are good with the longer part presently but if you seek to use the stated spare days then it affects the second part of absence requirements I.e. 90days in the last 12months

If you do this you will be OK, eg you are absent for 180 days to the 30 Sept 2024, you would need to wait until the 30 June 2025 with no more trips abroad. No issue for continued absence as long as all statutory requirements are met.

Thanks a lot for this answer. I now need to stay in the place of my birth longer. Probably until January/February time. If I come back in January my total absences for the last 5 years will be just under 450 days. If I then stay in the UKwithout going abroad till November 2025 and apply with the following <450 days in the last 5 years and <90 in the last year, does the latest absence of ~11 months affect my application given the extenuating circumstance of having to care for a relative?

As long as you are below the absence limits of 90 days in the last year and 450 in the qualifying period you will be ok. Just be mindful not to exceed the 2 years threshold to keep your ILR valid.
