How to answer ILR question about living together

Post by Orval1987 » Sat Apr 06, 2024 12:41 am

I'm driving myself insane with this one question, so any help is appreciated.

It's the question asking when you first lived with your partner.

I arrived in the UK on a fiancee visa, stayed with my husband in his apartment for a month (was not on the lease), then moved into a new apartment with him with both names on the lease shortly before we got married, and then received my spouse visa extension a month after.

Which date should I use?

— Date I came over on my fiancee visa because that's when I technically moved in with him?
— Date of our first lease kicking in, because that's the first place I had equal status on an apartment?
— Date my spouse visa was issued, because only then would I legally be "living" in the UK?

I feel like it should be the third one because that lines up with the question of how long I've "lived" in the UK (i.e. the duration of my spouse visa/residency permit) but I'm not sure if cohabitation is measured differently from legal residency. I know I'm overthinking it.

You began legally 'living' in the UK when you entered the country on your fiance visa. The 'equal status' has nothing to do with the question.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
