Need help with Set(M) questions please

Post by MHT005 » Mon Apr 15, 2024 3:58 pm

Hi, I hope you all are well. I have a few questions regarding Set(M), if someone could answer please. My wife is applying for ILR. She arrived in May 2018 and applying for ILR 28 days before her 5 years in the UK. She is using her own income to satisfy financial requirements.

Q-1: She is on a permanent role and her pay is above the threshold, however there is a question which asks if she earns ‘the same amount continuously, above financial requirement amount’. (there are 3 other options as well like – Not the same amount continuously, above financial requirement – Not the same amount continuously, below financial requirement and the same amount continuously, below financial requirement amount)

The problem is she got a salary increment this month so her this month’s pay is not the same as her previous 5 months’ pay. Although both her previous and current pay are above the threshold. So what option should we select for this question and would it mater if this question is answered wrong but the financial evidence shows she is above the threshold?

Q-2: This is linked to the above issue. There is a question asking for annual income. Would it be the latest one, as her annual salary increased and she received only for 1 month or the one which is in the last 5 months payslips?
They also ask for employer to confirm in the letter ‘the period over which the person has been paid the level of salary stated in the application’, which would be 1 month because before that the amount was different. So would it create any problem?

Q-3: When did you start living together?
We married in another country. I spent 3 weeks with her then and came back to the UK and applied for her visa. This process took almost 6 months that we were not living together. We are living together since her arrival in the UK. Which date should I state, the arrival date or marriage date?

Q-4: When did the relationship begin?
Would it be the date of engagement or wedding or when we first started to talk to each other and seeing each other.
And could a wrong answer in this question result in refusal?

Q-5: We started our application more than a week ago, and some rules regarding financial requirement have changed. Do we need to start the application all over again? She is still above the required amount.

I know I am asking a lot of questions but we just don’t want to mess it up at this stage and a small mistake may come back to bite us. So we would be really grateful if someone can answer these questions.

You seem to be overthinking way too much

1. That question is not about getting a raise. It is about being above the threshold continuously over the last 6 months
2. The answers on the form do not change her eligibility criteria. As long as she gets paid above the threshold her annual income becomes irrelevant
3. That date does not matter much and does not affect the ILR. You can use the date of marriage
4. That date does not matter much and does not affect the ILR. You can use the date you started dating.

These generic questions are asked to give the caseworker a view of your relationship and whether it looks genuine and subsisting. You do not need to worry much

Thanks Zimba - You are right, I am overthinking as it is a lot of money to apply again and all the hassle attached to it.
So I will select Same amount above required amount and will state the latest annual salary that is after the increment.
