FLR(M) Extension - Time spent living abroad

Post by genrespanner » Sun May 05, 2024 5:23 pm

I'm hoping for some advice regarding my husband's spouse visa extension, for which we are currently preparing the application.

During the period of his current spouse visa, we spent 15 months living abroad together in Germany, returning to the UK in September 2023. This was because my partner took up a one-year research fellowship, which included a three month language course for both of us. We have documents to evidence the stay in Germany and always intended to return permanently to the UK at the end of the fellowship.

While we were in Germany, we used my parents' UK address to receive correspondence, and also spent 3 months living at this address at the end of 2023. However, we did not return to the UK at any point during the 15 month stay in Germany

If the stay abroad is well explained and evidenced in the extension application, is it likely to cause a problem? Is there any specific evidence or piece of explanation that would be especially important for the caseworker to see?

I'm unsure as to whether the 2 years' shared correspondence we submit should cover our address in Germany or my parents' address in the UK where we also received correspondence. Can anyone advise on this?

Thanks in advance!

There is no absence limit on spouse visa route and no need to explain.
You have mitigated only likely fall out by having a UK address generating correspondence evidence.
