Father and Mother on ILR - apply ILR for Child

Post by softguy » Sat May 18, 2024 1:46 pm

Hi,

Thanks for this wonderful forum, Moderators and members who helped me for all my visa related queries. I have a new query.

I came to UK on Tier 1 visa and i have got my ILR before 9 years and my wife joined me later as dependant and now she also got ILR recently.

My child was born here in UK before my wife's ILR and so my kid was given 'Leave to Remain' before 2 years.
Now, since my wife has got ILR, i want to apply ILR for my child.

Questions:
1. Which form (HMRC website link) I need to use for applying for my Child ILR?
2. Is there any bank maintenance requirement for Child ILR? if yes, How Much?
3. My wife's ILR currently has the valid date till sep-2024, do i have to first apply for her ILR renewal and then apply for my child's ILR?
4. If my Child is given ILR, how many years the ILR validity will be given?

Thanks in advance.

The child could have been registered as British directly when one parent settles, did you not want that option ??
If not, why did you not include the child alongside your wife in the same ILR application ??

1. SET(O)
2. No
3. There is no such thing as ILR renewal. ILR is a permanent status and that date is just the expiry date of the BRP card. Also, note that BRP cards will be replaced by a digital status (eVisa) this year, so there is no need to renew the BRP cards anymore. Her ILR status remains unchanged, even after the BRP expiry date and the BRP expiry date is irrelevant.
See: Information on eVisas as all BPRs will be phased out from 1st Jan 2025
4. ILR is a permanent status and has no limited validity !!
