Student visa extension - Urgent advice needed please!

Post by SaraB200 » Sun Jun 16, 2024 3:59 pm

Hello, My university interrupted me from studies in March because I missed my classes due to medical reasons and was hospitalised. I have now received a visa curtailment notice from the Home Office, stating I must leave the UK by 10th July. I am scheduled to restart my studies on 10th September, but the university is not giving me a CAS to extend my visa in the UK.

They say I must leave the UK and apply for a new student visa from my home country. They are telling me that because of the UKVI academic progression rules, they cannot assign a CAS for me to extend my visa in the UK. However, I am requesting a new visa to repeat the failed modules, and I believe they can issue me a new CAS. Any advice on this would be highly appreciated.

They can issue a CAS but only for an application in your home country, not in the UK. To apply in the UK, there can be a maximum 28 day gap between the end of your current visa and the start of the course as listed on your CAS. Your gap is a lot longer than 28 days.

See Appendix Student, paragraph ST 4.3:

ST 4.3. An application for permission to stay must be for study on a course with a start date no more than 28 days after the expiry date of the applicant’s previous permission.
