ICT visa tax issue for ILR

Post by jisu0959 » Mon Jul 08, 2024 2:11 am

Hello,
I have an issue related to tax filing.
I came to the UK in Dec 2019 on ICT tier 2 visa and moved to a skilled worker visa in Dec 2022.
Initially, I registered myself for Self Assessment to take benefits of tax returns.
The problem is I am on PAYE so I made a blunder as I was not eligible for any tax return benefits.
It happened because I did read somewhere, not on the official site of course, that you can take tax benefits for the first 24 months but I think it's not true for PAYE. As soon as I realised my mistake, I called HMRC and told them about my problem.

Now I want to fix these past issues and want to pay back to HMRC as I don't want any issue for ILR. Could you please help me to fix this.

I have applied online for the Stop Self Assessment process as well bit didn't get anything from HMRC.

Thanks

This has no relevance to your ILR. There is nothing in the rules that suggests tax correction could lead to ILR refusal at all.
These queries are now asked because applicants do not understand the historical tax issues were related to the old Tier 1G route only.

See: viewtopic.php?t=348133#p2169037

The general grounds for refusal are clearly explained and defined by the rules, do not make assumptions.

Hi @zimba Thank You for your reply.
The issue is related to Intra company transfer visa(ICT) visa not the old one. I got an overpayment from HMRC and wanted to pay back as I am not self employed. I am not entitled to get any tax return benefits. I am on PAYE.

Thanks

It does not matter. You should seek to rectify this issue with HMRC but there be no ill effect on your ILR
