URGENT HELP NEEDED PLEASE!!

Post by Mina_7890 » Mon Jul 01, 2024 2:01 pm

Hi All,

I and my boyfriend are in relationship for 3 years and we are living together from Aug 2022 to till now, I'm now seeing to apply for unmarried partner visa but as it requires 2 year proof, I'm running short of 2 months to meet that eligibility. However, previous to that, we used to live together but no address proof as we used to stay in flats next to each other, I.e house no. 15 & 13 in the same street. I'm just wondering if this can effect my partner visa application in any way? My solicitor said, as it's more 20 months till date, it should be fine to go ahead with the application, but I'm still worried as it could result in rejection! I have just 10 working days from now on to make a new immigration application or leave the UK! Can you please suggest what options I got here?

Also, if I submit a new application now in July via standard process, which could take few months for the decision to arrive, while considering the decision do they check the 2 years eligibility based on that present day or the application date? Can anyone confirm please? If it's not application date, then can I get to apply the partner visa? [My boyfriend is currently on Tier 2 skilled visa].

Please HELP!!

PBS dependent Cohabitation

Post by Mina_7890 » Tue Jul 09, 2024 3:29 pm

Hi

I recently applied for PBS dependent visa on my Tier 2 partner (unmarried). We are currently running 3 months short for the 2 year Cohabitation requirement, but my biometrics is scheduled on Sept 4th, so that for August it would meet exact 2 years Cohabitation. But after going through few sources online, I'm just wondering, from what date would home office consider this 2 year thing? Does it count back from application date to 2 years or Is it from the Biometrics date?? Can some one please let me know about this?

Also, does time new rule for partner visa applies for PBS dependent too? I.e to have genuine and subsisting relationship rather than living together?

Please HELP!!
