Spouse Visa application tricky situation.

Spouse Visa application tricky situation.

Helllo all,
Im in little tricky situation with my partner visa application and need some inputs on this.
My situation is I'm a neutralized British citizen and got married in Dec 2023 and would like to sponsor my wife to UK!
I have been working in Uk but travelling to India quite frequently as my previous employer allowed me to work remotely. I was travelling to India quite frequently on monthly basis and with spending most of time in India. Now I changed my job in month of May 2024 and with my new employer I need to work in office 3 days a week hence I decided to not to travel to India as frequently as before. Both my current employment and previous employment are IR35 contracts. I could provide 12 month payslips and bank statement covering both the employment, P45. P60 and my salary is above 90k hence I don't foresee and issue with providing evidence)

We have applied for Visitor visa for my wife in June 2024 which got rejected as visa office found that my wife dint have reason to return to India as she was unemployed and we didn't submit Properties on her name. we applied for Visitor Visa based on assumption that we could apply for Spouse Visa after 6 months as its quite expensive to apply for Spouse visa.
Now we have decided to apply for Spouse visa as we don't have any other options to live together.
I could provide evidence of all the documents mentioned in the visa applications, Contract from both my current and previous the employers.
Salaryslips covering 12 months and bank statements showing the same.
And Bank balance of around 10K
Tenancy agreement
Proof of relationship (Marriage certificate, WhatsApp conversations and wedding pictures)
Mywife degree with ECOTIS certification confirm English as medium of instruction.

need advice in following points.
1 In section where it asks if there was any visa rejection. We said yes and mentioned that we applied for visitor Visa earlier in June 24 and it was rejected Now we decided that we wanted to start family in UK hence applying for spouse visa. - Will is cause any issue with my spouse visa application on is that anything that I need to mention?

2. Evidence of my employment meet 30k threshold. July 23- Apr 24 - Previous employer payslips and letter from employer confirmation my employment and annual salary. May
24- June 24 And current employer payslip and letter from employer confirmetion. Bank statements. P60 and P45. Both my employment are temporary employments - will my 2 employments cause any issues even after I am providing required evidence of both employments.

3. There was a question on why you don't live with your partner. We mentioned that I have been visiting her regularly and awaiting the visa to join in UK to start a family. is this
answer sufficient


4.Will previous Visitor Visa application cause any impact on fresh spouse application in short span. I'm providing all the evidence required.

5. Will my frequent visit to India cause any issues. if so any advise on how to address this
We both are divorcees and providing both the divorce orders from India courts.
Looking for valuable inputs and advise will be highly appreciated.

So the ECO was right. You tried to cheat the system.

You need to mention it, but it has no negative effect.

Freshly married people living in separate countries tend not to live together. Now you're trying to live together.

5. Will my frequent visit to India cause any issues. if so any advise on how to address this You're free to travel. Travelling to see her should also work in your favour.

Thanks for valuable inputs and guidance and it clarified lots of things for me.
I haven't seen any requirement for showing funds saving for spouse visa. I have lower balance in few of my statements for last 12 months. is there a requirement that we have to give evidence on our saving for specific amount?

You don't need to have savings in your account. You just need to show that you're in employment and earning at least £29k per annum. This can be shown by using 6 months statement of account and 6 months bank statements, if you've been in the same employment for 6 months. If not, then other ways.
How you prove your income depends on how you got it. You may be able to use your savings instead of income to show you meet the requirement.
