ILR continuous residence broken due to compassionate grounds

Post by ineedhelppls » Sun Jul 14, 2024 6:12 pm

Dear all,

Long time lurker, first time poster. I am applying for SET(LR). My first entry was on 2nd May 2014. I have been in the UK since then on various eligible categories. My total days out of country are at 545 days in the last 10 years.

Majority of this (about 320 days) is in one single event when I had to leave the UK to go look after my ill father. He suffered heart attack and sepsis, complications arising from his long term diabetes and CKD diseases that were in last stages back in 2021. I know I have broken 180 days rule but reading the guidance I assumed the compassionate grounds apply to my situation, however am not sure. This assumption is based on dialysis, CKD, cardiac failure and sespis seen as life threatening medical emergencies.

Queries:
1. Am I apply to still go ahead and make a SET(LR) application now, current visa expiry 25th July 2024 and write a cover letter explaining my one big break in residence?
2. I have letter from the doctor that treated him throughout his intensive care and who advised the need for day to day care since last 4 years. Is this sufficient along with a cover letter?
3. I do have various hospital admission letters spanning his continuous admittance to hospital in 2021-2022 when I was looking after him. Will submitting those help the case?
4. My father passed away this year in April, when I went to see him one last time again. Will submitting his death certificate, help?

In matters that comes under discretion, you can only submit all what is considered as evidence, cover letter and hope for the best possible outcome.

Thank you for writing back so quickly. Everyone mentions 'medical certificates' in similar threads here. Are these simply letters from doctors or something specific UKVI is looking for?
