British Nationality for children with settled status but currently staying abroad

Post by Lawrence77 » Wed Jul 17, 2024 8:41 pm

Hi,

I need some advice on British naturalization. Both my children have settled status but are currently studying in India. They come once a year with their mum to the UK for holidays. My wife recently got her settled status too. I want to know if both my children can apply for British nationality . Will there be any time restrictions for them . I have seen online that adults cannot be out of the country for 450 days in 5 years and 90 days in 1 year preceding application. Will this apply for my children ? Which form will they have to use ?

- I got my settled status 7 months after my younger son was born here in the Uk. Elder boy was born in India.

Thanks
L

How old are the children?
If under 18 they are children and can apply to be registered as British, using online form MN1. There are no specific absence limits.
If over 18 they are adults and need to comply with all requirements for naturalisation, such as absence limits, tests, etc. Using online form AN.

Younger child have an entitlement to register as a British citizen now as they were born in the UK and one parent has got settled status.

As they were born abroad, elder child does not have an entitlement to register as a British citizen. They can apply at discretion when they are in the UK and at least one parent has got or is applying for British citizenship and the child themselves and the other parent have got settled status.

Hi,

I have applied for naturalization this Month . After I get my British citizenship , I wanted both children to get BC also. Just wanted to be sure that there is no time restrictions since they are both studying outside the UK.

Youngest child can apply already, no issue I don't think with them being abroad but applications submitted form abroad notoriously take a lot longer. I suggest youngest child can apply when in the UK and eldest child can apply once you receive naturalisation and they are back in the UK.
