Child depdendant of Skilled Worker Given Visa According to other Parent s remaining Leave/time Duration

Respected Members I have got a complex issue. My kids have been granted leave to remain according to their father s Student Visa which is expiring on 31st July 2024. I have leave to remain for 5 years and now my husband is switching to my dependant (Skilled worker dependant). We have only realized now when we did not receive any decision letter and brps. Brp correction team has emailed us that visa has been granted in line with father not the mother(Skilled Worker). My question is
1. Do we need to make new FLR application for children or wait for father s application s out come
2; We paid full IHS and if we make new application do we need to pay ihs again or we can use previous ihs reference as we have not received any decision letter or refund yet?

If the irrational SW 26.4A. prevents father from applying in the UK, then he should make an entry clearance application from his home country.

1. Father may include the children in his (in-UK) dependant application. Or they may also apply separately, in-line with father, before their leave expires.

2. Pay the appropriate IHS fees again. Expect a refund for overlapping IHS period.

Thanks a lot for prompt reply. The over lapping period is less than 5 weeks and while filling application when I use previous IHS reference it still accepts it or we can put previous application reference when we start application.

I think that they require applicants to pay all fees again.

Forgot to ask. Hopefully, you don’t have a SOC code that may also prevent dependants from applying?

In my case SOC code does allow dependants. I was only concerned about paying IHS again as I have just arrived and its not easy to manage payment straight away.

SOC Code does not prevent Dependant s Applications. I tried pevious IHS reference and its been accepted as well. Now double minded should i pay or should i use old references.
