Spouse visa after being absent from the UK for 2 years

Post by lindajulian27 » Mon Aug 12, 2024 5:27 pm

Dear Moderators,

I’m a British citizen and my husband is on a spouse visa which is expiring on the 18th of November. We have both been living and working in the US for the past two years. I am planning to move back to the UK and I have a job offer starting in October. I will be meeting the income requirements for his visa. I have the following questions
1) Should I be employed for a certain period of time or show x number of payslips for his application? Would an employer letter suffice?
2) Could he apply for an extension of his current spouse visa? Because we haven’t been in the UK for 2 years, does he have to apply for a new spouse visa or can he apply for spouse visa extension?

There is no absence limit on spouse visa route, therefore extension can be applied.
The absences will come to be accounted for or factored in for SET M.

Thanks for your prompt reply. Should I be employed for a certain period of time or show x number of payslips for his application? Would an employer letter suffice? I will only start work in the UK in October and his current spouse visa expires in November.

Having a job that meets the financial requirements and to start within 3months is accepted for initial spouse visa application, not exactly sure this hold true for extension.
Or if your foreign job meeting the financial requirements suffices.

Hi,

As part of the spouse visa application, my husband been asked to provide an address where we lived together for the past 2 years. We were in the UK for only the first 6 months and was in the US for the remaining period. We are not able to provide the US address as the application website is unable to recognise the US post code. Can you let me know how to proceed.

Have you clicked Vinnys 'be careful' link and read the advice?
