Fiancee Visa Adequate Maintenance Question Regarding UC

Fiancee Visa Adequate Maintenance Question Regarding UC

Hey all, me and my fiancee are hoping to get a fiancee visa relatively soon, and we're planning on going the adequate maintenance route as I claim PIP and UC and have done so for many years.

Recently, there was an error in communication and my UC claim was closed without warning. It was forced to make a new claim after a period of illness of about a month.

My fiancee worries that this will affect our ability to do the adequate maintenance, she's concerned that I might need to have claimed UC for a certain period of time for it to count towards adequate maintenance and because there was a gap and technically it's a different claim, that it might be a problem and count from then, not from when I first claimed it years ago.

So my question is, do I have to have been claiming UC for a certain period of time for it to be able to be included as part of adequate maintenance?

I'd really appreciate an answer, as we've not been able to find anything anywhere about it.

Yes, I know, but do you think I need to have had the UC for a certain period of time? We're hoping to add that to the PIP to cover the financial requirement of it.

When calculating income under paragraphs 13 to 16, the following sources will not be counted:
  • (a) Loans and credit facilities.
  • (b) Income-related benefits: Income Support, income-related Employment and Support Allowance, Pension Credit, Housing Benefit, Council Tax Benefit or Support (or any equivalent) and income-based Jobseeker’s Allowance.
  • (c) The following contributory benefits: contribution-based Jobseeker’s Allowance, contribution-based Employment and Support Allowance and Incapacity Benefit.
  • (cc) Unemployability Allowance, Allowance for a Lowered Standard of Occupation and Invalidity Allowance under the War Pension Scheme.
  • (d) Child Benefit.
  • (e) Working Tax Credit.
  • (f) Child Tax Credit.
  • (ff) Universal Credit.
  • (g) Any other source of income not specified in this appendix.
