ILR - Dependant has long gap

Post by roadjacker80500 » Mon Jul 01, 2024 7:26 pm

I have qualified for ILR in July 2024 after completing 5 years on PBS/Tier2 visa and am planning to apply soon.
However, my partner only moved to the UK as tier 2 dependant 12 months ago. Her tier 2 dependant visa is valid only till July 2025 and she will still need another 3 years visa extension to complete 5 years period or switch to spouse visa (and then complete 5 years again) after I obtain ILR.
We are also expecting a baby in November.
My current Tier2/PBS visa is valid till July 2025. My COS states employment end date as July 2025.
I don't have to pay IHS for myself and the dependant due to the job category.

q1: What is the best course of action in terms of planning for my dependant's ILR keeping in view that we will also be having a baby soon? should they go for visa extension route or spouse visa route?

q2: As my job contract ends in July 2025, will my partner even be able to apply for extension of dependant visa if we go down visa extension route and not the spouse visa route? (provided I apply for and already get ILR now)

q3: When I first came to the UK in July 2019, I picked my BRP from post office and left the UK after 3 days. I then came back to the UK at the end of August 2019 (i.e. 55 days later) to start work. Should I wait till August 2024 or go ahead and apply for ILR?

Thanks a lot for help.

1. As you settle under that route, she can extend her visa under the skilled worker dependant route as normal
2. Her visa extension has nothing to do with your job. She will get a 3-year extension if you get ILR
3. You do not need to wait

Thanks for the advice. I recently got my ILR.
My partner is still on tier 2 dependant visa and it will expire July 2025. Will she need to renew her visa now or just before her visa expiry in July.

She should renew close to her visa expiry in 2025
