I am a British citizen currently preparing to apply for a spouse visa for my wife, who is from Asia. I am employed full-time by ABC Pvt Limited, a UK-based company, where I have been working for the past two years. My brother is the director of this company.
For the last six months, I have been employed full-time, earning a gross monthly salary of £2,500. I believe I meet the financial requirement under Category A for my wife's spouse visa application. However, I would appreciate clarification on a few points regarding the financial assessment.
The company’s tax year runs from 1 November to 31 October, and the most recent accounting period was from 1 November 2022 to 31 October 2023. During that period, my gross salary was £1,500 per month. As the company is owned by my brother, I am concerned whether it would be classified as a "specified company" under immigration rules, and whether I can still use my last six months' income to meet the financial requirement.
To summarise, I am seeking advice on the following:
Can I use my income from the last six months (where I earned £2,500 per month) to meet the financial requirement under Category A, even though my salary in the previous financial year was lower (£1,500 per month)?
Given that my brother is the director of the company, does this classify ABC Pvt Limited as a "specified company," and how might this affect my application?
I would greatly appreciate your guidance on how to proceed with my spouse visa application under these circumstances.
